Your privacy is fundamental to SailerAI LTDA., registered under CNPJ/MF No. 56.057.244/0001-65, with headquarters at Rua Luiz Dias da Costa, 680, Jardim Santana, Franca–SP, 14403-064, Brazil ("SailerAI", "we", "us", "our").

This Privacy Policy describes how we process personal data in the context of providing our Artificial Intelligence sales automation services, in compliance with the General Data Protection Law (LGPD) and other applicable regulations.

This document aims to fulfill the duty of transparency, detailing how your data is processed when you interact with one of our clients who uses our platform.

1. The Role of SailerAI and Our Clients

SailerAI acts as a Processor of personal data. This means that we process data on behalf of and under the instructions of our clients, who are the Controllers of the data.

The Controller (the company with which you are communicating) is primarily responsible for your data, for defining the legal basis for processing (such as legitimate interest, performance of a contract, or consent), and for decisions regarding the purposes of its use. SailerAI provides the technology for these purposes to be achieved securely and efficiently.

2. Storage, Sub-processors, and International Data Transfer

To offer a robust and state-of-the-art service, we use a secure infrastructure and rely on technology partners (sub-processors).

• Primary Storage in Brazil: Our main infrastructure, including application servers and databases where conversations are stored, is located in Brazil, in high-security data centers of Amazon Web Services (AWS) in the São Paulo region.
• International Transfer for Processing: Some stages of our service require the use of technologies located outside of Brazil. These transfers are carried out for specific purposes and with appropriate security guarantees:
  • Artificial Intelligence (OpenAI):
    • Sub-processor: OpenAI, L.L.C.
    • Country of Destination: United States of America.
    • Purpose: To process the content of messages to interpret, contextualize, and generate automatic responses, enabling the "AI Sales" service contracted by our clients.
  • AI Observability and Diagnostics (LangSmith):
    • Sub-processor: LangChain.
    • Country of Destination: United States of America.
    • Purpose: To save technical logs of AI interactions for monitoring, performance analysis, and debugging, ensuring the proper functioning and continuous improvement of our technology's accuracy.
  • Infrastructure Monitoring (Datadog):
    • Sub-processor: Datadog, Inc.
    • Country of Destination: United States of America.
    • Purpose: To collect logs and performance metrics from our application to ensure the stability, security, and availability of our services.

For all sub-processors, SailerAI has Data Processing Agreements (DPAs) that impose contractual security and data protection obligations compatible with Brazilian law.

3. What Data is Processed?

The categories of personal data we process include:

• Registration Data: Name and phone number associated with your WhatsApp account.
• Content of Conversations: Any information you voluntarily provide during the interaction, which may include identification data, information about commercial interests, professional data, or other information relevant to the context of the conversation.
• Technical Data: Interaction metadata, such as date and time, for logging and organizational purposes.

We do not actively request sensitive personal data. If you provide it voluntarily, we recommend that you do not share information that is unnecessary for the purpose of the interaction. Our services are not directed at individuals under 18 years of age, and we do not intentionally process data from children or adolescents.
